All orders placed through this web site are subject to the final confirmation and acceptance by OzSports.

OzSports may at its own discretion vary the prices of its merchandises without prior notice. In the event of any price changes or mistakes made by OzSports , OzSports shall give a notice to the customer of the changes or mistakes and if the customer accepted the changes or mistakes and to continue with the order, then the customer shall make further payment with the difference in price no later than seven day after the notice was given. If OzSports did not received the further payment of the difference, then the order would be cancelled and whereupon, OzSports would refund the money to the customer as soon as practicable.

Upon receipt of payment and upon acceptance by OzSports of the order, OzSports or its agent will cause the delivery of the goods you order to the address you specify in your order, within a reasonable time frame, subject to their availability. Where the goods are not available you will be notified of this by OzSports as soon as possible. Anyone at the delivery address who receives the goods will be deemed by OzSports to be authorised agent to receive the goods.

Once the goods are delivered to you, you will own them and it is your responsibility if they are lost or damaged.

OzSports reserves the right to restrict sales to retail quantities when supplying resellers and distributors.
Delivery normally takes up to 10 working days depends on stock availability and delivery locations.

Under OzSports ‘change of mind’ policy, if you simply change your mind we may offer an exchange provided that:
(1) you return the item within 14 days from the date of purchase; and
(2) the item is unworn and in its original condition; and
(3) the original tag is attached to the item; and
(4) you provide our receipt as proof of purchase.

OzSports is not obligated to give refunds if you;
(1) change your mind about a product (this includes but not limited to when you have found a cheaper product elsewhere, has bought a gift that is unsuitable, or their circumstances have changed and you no longer require the goods)
(2) knew, or should have known about a fault when the goods were bought,
(3) are unable to prove from whom and when the item was purchased.
(4) are responsible for damaging the goods by not following the instructions, or misusing the product.

OUR CUSTOMERS' RIGHT TO A REFUND
We will exchange or refund if the item is faulty, not of merchantable quality or not fit for its purpose and you return the item within 14 days after purchase and provide us with proof of purchase, such as receipt or bank statement. If you do not return the item within this period of time , you will only be entitled to exchange.

OzSports reserves the right to ask you to demonstrate that you did not cause or create the fault in the item.

If you are entitled to a refund but you would prefer to exchange the item, we are happy to do this for you.

ONLINE CUSTOMERS
For online customers, the Return Policy also applies; however please note the following terms and conditions:

Should you wish to exchange the item, please enclose with your goods a postage paid, self addressed bag and your receipt and send to the address below. Please note: all postage costs will be covered by the customer.

For your convenience, items purchased online may be exchanged for an alternative size or colour at any of our OzSports stores provided all of the Return Policy conditions are met. However, items purchased online will not be exchanged for an alternative style or refunded at any of our OzSports stores.

For each online order, you must pay:

- the applicable price for the relevant goods confirmed by OzSports; and
- the delivery and handling fee specified on the web site at that time.

Your order and credit card details are safe and secure. All personal and credit card information provided to OzSports is encoded using Secure Sockets Layer (SSL) technology, an encryption protocol that protects data as it travels over the Internet.

- At this stage we can only accept payments using the methods stated in the Orders & payment section of this web site.
- We are unable to accept COD charges.
- Payment must be cleared before the goods are dispatched.

Our customer representative will contact you if you have an order over $500. For security purposes you will be requested to provide identification such as a license and other identification as our customer representative deems fit.

You agree to take responsibility for the safekeeping of your user name and password. You are liable if your user name or password is used by an unauthorised person. You agree to hold OzSports harmless and release and indemnify OzSports of any damage or loss that arises from the use(whether authorised or unauthorised) of your user name or password. OzSports may suspend or cancel your account at any time without prior notice.

OzSports aims to provide as nearly as possible the specifications of the goods and that include up-to-date pictures of all of the goods on this web site. However, the picture of the goods may differ in colour slightly and minor details from the actual goods.

We recommend you read the labels on the goods carefully before using the goods.

OzSports will comply with its Privacy Statement. OzSports will not disclose your personal information to external organizations except for the purposes of fulfilling your order or as required by the Law.

OzSports shall not be liable in connection with goods or services supplied to you subject only to those implied by legislation and to the maximum extent permitted by law, OzSports shall only be liable to the following:

In relation to goods, the replacement of the goods or the supply of equivalent goods; and

ii. in relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.

Each order is governed by the terms and conditions then current when the order is placed. OzSports reserve the right to add to, to delete or otherwise to change the terms and conditions without notice. It is your responsibility to read and understand the terms and conditions each time you place an order.

All purchases, and these terms and conditions, are subject to the laws of New South Wales and all states of Australia.
